Rheoliadau’r Gwasanaeth Iechyd Gwladol (Ffioedd Ymwelwyr Tramor) (Diwygio) (Cymru) 2014

NODYN ESBONIADOL

(Nid yw’r nodyn hwn yn rhan o’r Rheoliadau)

Mae’r Rheoliadau hyn yn diwygio Rheoliadau’r Gwasanaeth Iechyd Gwladol (Ffioedd Ymwelwyr Tramor) 1989 (“y prif Reoliadau”).

Mae rheoliad 5 o’r prif Reoliadau yn nodi o dan ba amgylchiadau y bydd ymwelydd o dramor yn esempt rhag ffioedd am driniaeth y cododd yr angen amdani pan oedd yr ymwelydd o dramor yn ymweld â’r Deyrnas Unedig.

Mae’r Rheoliadau hyn yn diwygio’r prif Reoliadau i ddarparu esemptiad i unigolion sydd yng Nghymru fel rhan o Deulu Gemau’r Gymanwlad yn ystod Gemau’r Gymanwlad yn Glasgow rhwng 19 Gorffennaf a 7 Awst 2014, fel rhan o Deulu Pencampwriaethau Athletau Ewropeaidd y Pwyllgor Paralympaidd Rhyngwladol yn ystod Pencampwriaethau Athletau Ewropeaidd y Pwyllgor Paralympaidd Rhyngwladol yn Abertawe rhwng 14 a 27 Awst 2014 ac fel personau achrededig a fydd yn bresennol yn uwchgynhadledd Sefydliad Cytuniad Gogledd Iwerydd rhwng 2 a 6 Medi 2014.

Mae rheoliad 2(5) yn mewnosod Atodlen 4 newydd yn y prif Reoliadau sy’n diffinio’r hyn a olygir gan “Commonwealth Games Family”, “IPC Athletics European Championships Family” a “NATO delegate or accredited person”.

Mae’r Rheoliadau hyn hefyd yn dirymu Atodlen 3 i’r prif Reoliadau a oedd yn darparu esemptiad i unigolion a oedd yn rhan o Deulu’r Gemau yn ystod y Gemau Olympaidd a Pharalympaidd yn Llundain 2012.

Ystyriwyd Cod Ymarfer Gweinidogion Cymru ar gynnal Asesiadau Effaith Rheoleiddiol mewn perthynas â’r Rheoliadau hyn. O ganlyniad, ystyriwyd nad oedd yn angenrheidiol cynnal asesiad effaith rheoleiddiol o’r costau a’r manteision sy’n debygol o ddeillio o gydymffurfio â’r Rheoliadau hyn.

Mae Gweinidogion Cymru yn gwneud y Rheoliadau a ganlyn drwy arfer y pwerau a roddwyd gan adrannau 124 a 203(9) a (10) o Ddeddf y Gwasanaeth Iechyd Gwladol (Cymru) 2006([1]).

Enwi, cychwyn, cymhwyso a dehongli

1.(1) Enw’r Rheoliadau hyn yw Rheoliadau’r Gwasanaeth Iechyd Gwladol (Ffioedd Ymwelwyr Tramor) (Diwygio) (Cymru) 2014 a deuant i rym ar 19 Gorffennaf 2014.

(2) Mae’r Rheoliadau hyn yn gymwys o ran Cymru.

(3) Yn y Rheoliadau hyn, ystyr “y prif Reoliadau” (“the principal Regulations”) yw Rheoliadau’r Gwasanaeth Iechyd Gwladol (Ffioedd Ymwelwyr Tramor) 1989([2]).

Diwygio’r prif Reoliadau

2.(1) Mae’r prif Reoliadau wedi eu diwygio fel a ganlyn.

(2) Yn rheoliad 1(2) (dehongli) hepgorer y diffiniad o “the relevant period”.

(3) Yn rheoliad 5 (esemptiad rhag ffioedd ar gyfer triniaeth y cododd yr angen amdani yn ystod yr ymweliad), yn lle paragraff (g) rhodder—

(g) an individual who is in the United Kingdom–

                       (i)  as part of the “Commonwealth Games Family”, as defined in paragraph 1 of Schedule 4, during the period from 19 July 2014 to 7 August 2014 inclusive;

                      (ii)  as part of the “IPC Athletics European Championships Family”, as defined in paragraph 2 of Schedule 4, during the period from 14 August 2014 to 27 August 2014 inclusive; or

                     (iii)  as a “NATO delegate or accredited person”, as defined in paragraph 3 of Schedule 4, during the period from 2 September 2014 to 6 September 2014 inclusive.”.

                                    Regulation 5(g)

Definition of Commonwealth Games Family, the IPC Athletics European Championships Family and a NATO delegate or accredited person

1. “Commonwealth Games Family” —means the group of individuals who are taking part or are involved in the Commonwealth Games in Glasgow and who have been given a letter code for the purpose of receiving free treatment the need for which arose during the visit to the United Kingdom.

2. “IPC Athletics European Championships Family” —means the group of individuals who are taking part or involved in the International Paralympic Committee (“IPC”) Athletics European Championships in Swansea.

This includes the following groups:

Athletes – comprising athletes and their supporting team officials participating in the Championships as accredited members of the IPC or local organising committee (“LOC”);

Technical officials – comprising the team of individuals that officiates the field of play and athletic areas at the Championships;

Press – comprising the IPC or LOC accredited representatives of photographic and written press;

Broadcasters – comprising the IPC or LOC accredited broadcast personnel and all the Championships-related rights holding broadcasting organisations;

Championships family – comprising the IPC or LOC organisations (and their constituents), Chairs and Chief Executive Officers (or equivalent).

 

3. “NATO delegate or accredited person” —means a delegate or a NATO accredited person attending the North Atlantic Treaty Organization (“NATO”) summit in Newport in 2014.

This includes the following groups:

Heads of State or Government of any of the nations represented at the summit – comprising the person responsible for carrying on the business of government and/or for leading the team of Ministers who control the central institutions of the government and the state;

Ministers of any of the nations represented at the summit;

Foreign Secretaries of any of the nations represented at the summit – comprising the persons who are the principal advisors on foreign policy;

Defence Secretaries of any of the nations represented at the summit – comprising the persons who are the principal advisors on defence policy;

Officials – comprising individuals officially assigned to support the categories above;

Accredited Security – comprising the team of individuals assigned to security duties;

Media representatives – comprising NATO accredited representatives of the photographic and written press.”.
